This website is operated by Klara Kattwinkel. Throughout the site, the terms “we,” “us,” and “our” refer to Klara Kattwinkel. Klara Kattwinkel offers this website, named in.klarity, including all information, tools, products, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service,” “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Any new features, tools, or products added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on an e-commerce platform that allows us to sell our products and services to you.
1. SCOPE
1.1 These general terms and conditions apply to all legal transactions of sole proprietor Klara Kattwinkel (hereinafter referred to as “Psychologist”) with her respective private clients (hereinafter referred to as “Clients”) and customers purchasing physical journals, eBooks, and other digital products through in.klarity.
1.2 The website in.klarity serves as both a platform for facilitating psychological services and an online store for digital products, journals, and eBooks. The execution and invoicing of the services and digital sales are the sole responsibility of Klara Kattwinkel.
1.3 Changes to these terms and conditions will be communicated to Clients and customers in writing. They are deemed approved if the Client or customer does not object in writing within two weeks of the announcement.
2. SUBJECT OF CONTRACT
2.1 The Psychologist offers individual sessions both online and in person.
2.2 In addition to psychological services, in.klarity sells digital products, including eBooks and journals, which are delivered electronically or in physical format.
2.3 All contracts concluded based on these Terms of Service are service contracts unless expressly agreed otherwise. The contract entails the provision of professional psychological services or digital product sales, with the commitment to professional effort but without guaranteeing a particular outcome. The Psychologist provides services based on the information provided by the Client.
3. FORMATION OF CONTRACT
3.1 A contract with the Psychologist is concluded by electronic transmission and confirmation of a signed offer or by verbal and telephone agreement.
3.2 For purchases of digital products, the contract is concluded once payment has been successfully processed, and the product is made available for download or shipment.
3.3 Each Client or customer receives a confirmation or rejection after submitting an inquiry or purchase request.
3.4 If a session is canceled by the Psychologist, fees already paid will be refunded within 14 days. Digital product sales, once completed, are final and non-refundable unless there is a technical issue preventing access to the product.
4. DURATION AND PAYMENT
4.1 The contract begins and ends at the specifically agreed time for services, while purchases of digital products are considered fulfilled once delivery occurs.
4.2 Payment terms: The fee for sessions, events, physical journals, and digital products is determined by the current price list at the time of contract conclusion. Payment is made via invoice or the payment method offered through the online store. Prices for all products and services are subject to change without prior notice.
4.3 All payments are due within 14 days of invoicing without deduction. If payment is not received within the specified period, a reminder will be sent. If the delay exceeds 30 days, a late fee of 5% of the outstanding amount may apply.
4.4 Digital products must be paid for in advance before they are made available for download or shipped.
4.5 Travel, accommodation, and other expenses of the Psychologist will be charged separately by agreement. A mileage rate of €0.30 per km applies for car travel, and train travel is billed at 2nd class rates.
5. SERVICE SCOPE AND UNUSED SERVICES
5.1 The scope of services is determined by the individual agreement between the Psychologist and the Client.
5.2 Booked packages must be used within one full calendar year. The specific timeframe is stated in the confirmed offer. Unused sessions may be voided after this period.
5.3 All digital products and physical journals sold on in.klarity are for personal, non-commercial use only. Redistribution, reselling, or modification of these products is strictly prohibited.
6. CANCELLATION POLICY
6.1 Individual sessions – Appointments can be canceled free of charge up to 48 hours before the session. A session is considered confirmed when it has been acknowledged in writing or digitally by the Psychologist. If canceled less than 48 hours before the session, 50% of the session fee will be charged. In case of no-show without prior cancellation, 100% of the session fee will be charged. Exceptions may be considered in the event of grave medical emergencies at the discretion of the Psychologist.
6.2 Digital products & physical journals – Due to the nature of digital downloads, refunds or exchanges are not possible once a purchase has been completed, except in cases of technical failure preventing access to the product. 7. CONFIDENTIALITY
The Psychologist is obliged to maintain confidentiality regarding all content and information shared by the Client during and after the contract period. Confidentiality will be upheld at all times, except in cases where disclosure is legally required, such as imminent danger to the Client or others.
8. LIABILITY
8.1 The Psychologist is liable for damages only in cases of intent or gross negligence. Liability for guarantees is independent of fault. For slight negligence, liability is limited to breaches of essential contractual obligations, and damages are capped at foreseeable damages.
8.2 The limitation of liability extends to claims for damages in all legal grounds, including defects, delay, or impossibility.
8.3 Digital product liability – in.klarity does not guarantee uninterrupted access to digital products, and we are not responsible for technical issues on the customer's side, such as device incompatibility or software conflicts.
9. OTHER PROVISIONS
All side agreements must be in writing to be valid.
